1. Introduction
Welcome to AppEatByte. These Terms and Conditions ("Terms") apply to your use of the AppEatByte website, mobile applications, and any related services (collectively, the "Platform"), operated by AppEatByte Ltd ("AppEatByte", "we", "us", or "our"), registered in England and Wales.
By accessing or using the Platform — whether to browse, place an order, book a table, or use any other feature — you confirm that you have read, understood, and agree to these Terms. If you do not agree, please stop using the Platform immediately.
These Terms should be read alongside our Privacy Policy and Cookie Policy, which are incorporated by reference.
2. Definitions
In these Terms, the following words have the meanings set out below:
- "Customer" or "you" means any individual who accesses or uses the Platform.
- "Merchant" means any restaurant, food business, or food and beverage operator listed on the Platform.
- "Order" means a request you place through the Platform for food or drink from a Merchant.
- "Order Contract" means the contract formed directly between you and the relevant Merchant when your Order is accepted.
- "Services" means all features available on the Platform, including ordering, delivery, collection, dine-in ordering, table booking, and promotional offers.
- "Content" means any text, images, reviews, ratings, or other material submitted through the Platform.
3. Eligibility & Accounts
To use the Platform you must be at least 18 years old, or if you are between 13 and 17 years old you may only use the Platform with the consent and supervision of a parent or legal guardian. By using the Platform you confirm you meet these requirements.
Some features require you to create an account. When registering you agree to:
- provide accurate, current, and complete information;
- keep your password secure and not share it with anyone;
- notify us immediately at support@appeatbyte.com if you suspect unauthorised access to your account; and
- accept responsibility for all activity that takes place under your account.
We reserve the right to suspend or terminate your account if we have reasonable grounds to believe you have breached these Terms, or for reasons of security or fraud prevention.
4. Use of the Platform
AppEatByte grants you a personal, non-exclusive, non-transferable, revocable licence to use the Platform for your own private, non-commercial purposes.
You must not:
- use the Platform for any unlawful purpose or in breach of applicable laws or regulations;
- use the Platform to place fraudulent, speculative, or false Orders;
- attempt to access any part of the Platform or its underlying systems without authorisation;
- use automated tools, scrapers, or bots to interact with the Platform;
- copy, reproduce, distribute, or create derivative works from any Platform content without prior written consent; or
- post, upload, or transmit any material that is offensive, defamatory, infringing, or otherwise harmful.
We reserve the right to restrict or terminate your access to the Platform if you breach these conditions.
5. Orders & Payments
When you place an Order through the Platform, you are making an offer to purchase from the relevant Merchant. An Order Contract is formed between you and the Merchant when your Order is accepted (confirmed on screen and/or by notification). AppEatByte is a technology facilitator and is not a party to the Order Contract.
All prices displayed on the Platform are set by the Merchant and include applicable VAT. Merchants are not permitted to surcharge you for using the Platform, so the prices you see are the prices you pay.
Payment is taken at the time you place your Order via the payment methods available on the Platform. We use secure, PCI-compliant third-party payment processors to handle transactions; we do not store your full card details.

6. Delivery, Collection & Dine-In
Delivery: Estimated delivery times shown on the Platform are provided by the Merchant and are indicative only. Actual delivery times may vary due to factors outside our or the Merchant's control, including traffic, weather, and order volume. AppEatByte is not liable for late or failed deliveries.
Collection: When you select collection, your Order will be prepared for you to pick up at the Merchant's premises within the estimated time shown. Please bring your order confirmation when collecting.
Dine-In & Table Ordering: Where a Merchant supports scan-to-order or table ordering, the Order Contract is formed when your order is accepted by the Merchant's system. Normal payment terms apply.
Table Bookings: Table reservations made through the Platform are subject to the individual Merchant's booking policy, including any cancellation and no-show charges. AppEatByte is not responsible for a Merchant's failure to honour a reservation.
7. Cancellations & Refunds
Once an Order has been accepted by a Merchant it may not be possible to cancel it. If you need to cancel, please contact the Merchant directly through the Platform as soon as possible.
You are entitled to a refund if:
- the Merchant cancels your Order;
- the items you receive are materially different from those described on the Platform;
- your Order does not arrive within a reasonable time, or at all; or
- the food is unsafe or not of satisfactory quality.
Your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms. To request a refund, contact support@appeatbyte.com or use the in-app help feature within 24 hours of receiving (or not receiving) your Order.
Refunds will be processed to your original payment method within 5–10 business days, subject to the Merchant's confirmation.
8. Promotions & Offers
AppEatByte and individual Merchants may from time to time offer discounts, vouchers, or promotional deals through the Platform. The following conditions apply:
- Promotions are subject to their own individual terms, including expiry dates, minimum spend thresholds, and eligible items.
- Discount codes can only be applied at checkout and cannot be combined with other offers unless stated otherwise.
- AppEatByte reserves the right to withdraw or modify promotions at any time without notice if they are subject to abuse or error.
- Promotional credits issued by AppEatByte have no cash value and cannot be transferred or exchanged.
9. Acceptable Use
When you submit reviews, ratings, or any other Content to the Platform, you confirm that:
- the Content is your own honest and genuine experience;
- the Content does not infringe any third party's rights;
- the Content does not contain offensive, threatening, defamatory, or discriminatory material; and
- you grant AppEatByte a royalty-free, non-exclusive licence to display and moderate the Content on the Platform.
We reserve the right to remove any Content that we consider, in our sole discretion, to violate these guidelines or to be otherwise harmful to the Platform, its users, or Merchants.
Repeated misuse — including placing fake Orders, submitting false reviews, or any form of fraud — will result in permanent account suspension and may be referred to the relevant authorities.
10. Intellectual Property
All intellectual property rights in the Platform — including the software, design, branding, trade marks, and content produced by AppEatByte — are owned by or licensed to AppEatByte Ltd. Nothing in these Terms grants you any rights in that material beyond the limited licence described in clause 4.
The "AppEatByte" name and logo are trade marks of AppEatByte Ltd. You must not use them without our prior written consent.
Menu content, photographs, and descriptions belong to the respective Merchants and must not be reproduced without their permission.
11. Data Protection & Privacy
We take your privacy seriously. Our Privacy Policy explains how we collect, use, store, and share your personal data when you use the Platform, and sets out your rights under UK GDPR and the Data Protection Act 2018.
When you place an Order, we share the minimum necessary personal data (such as your name, delivery address, and contact number) with the relevant Merchant solely for the purpose of fulfilling that Order. Merchants are not permitted to use your data for any other purpose.
By using the Platform you acknowledge that you have read and understood our Privacy Policy.
12. Limitation of Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be lawfully excluded.
Subject to the above:
- AppEatByte acts as a technology intermediary. We are not a party to the Order Contract between you and the Merchant, and we are not responsible for the quality, safety, or legality of food or other goods supplied by Merchants.
- Our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the value of the Order to which the claim relates or £100, whichever is greater.
- We are not liable for any indirect, incidental, consequential, or special loss, including loss of data or loss of enjoyment.
- We do not warrant that the Platform will be available at all times, free of errors, or free from viruses or other harmful components. We will use commercially reasonable efforts to maintain service availability.
Your statutory rights as a consumer are not affected by these limitations.
13. Third-Party Links & Content
The Platform may contain links to third-party websites or services (for example, map providers or payment processors). These links are provided for convenience only. AppEatByte has no control over and accepts no responsibility for the content, privacy practices, or availability of any third-party sites. Visiting those sites is at your own risk.
Merchant-supplied content such as menu descriptions, photographs, and allergen information is the sole responsibility of the Merchant. While we encourage Merchants to keep their listings accurate, we cannot independently verify all content and accept no liability for inaccuracies.
Allergen information: If you have a food allergy or intolerance, please contact the Merchant directly before placing your Order to verify allergen details. Do not rely solely on the information shown on the Platform.
14. Amendments
We may update these Terms from time to time. We will notify you of material changes via the Platform or by email to the address registered to your account, giving at least 14 days' notice before the changes take effect.
If you do not accept the updated Terms, you should stop using the Platform before the effective date. Continued use after that date constitutes your acceptance of the revised Terms.
Minor corrections or clarifications that do not materially affect your rights may be made without notice.
15. Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
If you have a complaint, please contact us first at support@appeatbyte.com — we aim to resolve all issues promptly and fairly. If we are unable to resolve a dispute informally within 30 days, you may refer it to an alternative dispute resolution (ADR) scheme or to the courts of England and Wales.
As a consumer in the UK you may also have the right to refer disputes to the UK Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
